We are pleased to know that you are one of the leading exporter and producer of sodium Hydro Sulphite in China. We took the liberty to inform you that Designated Authority in India had initiated a sunset review investigation of existing antidumping duties on imports of Sodium Hydro Sulphite (SHS) from China. The petition for continuation of duty has been filed by M/s. Transpek Silox Ltd and M/s. Demosha Chemicals ltd.

Brief history of the investigation conducted so far on the product under consideration is tabulated below for your reference: -

The above mentioned anti dumping measure as recommended by the Designated Authority and will remain in force till 12th March 2006, unless the designated authority on the request of Indian manufacturing industry decides to initiate a sunset review investigation. In case a sunset review investigation is initiated than the duty will provisionally remain in force till the final outcome of investigation.

What is a Sunset/Expiry Review?

“Under the Agreement (Article IV of GATT 1994), anti-dumping orders must expire - or "sunset" - within five years of their imposition. In certain limited circumstances, importing countries may extend the order beyond the scheduled expiration date, provided that they comply with the strict conditions set out in the Agreement to do so. An anti-dumping order can be extended only where the importing authorities determine that expiry of the duty would be "likely to lead to continuation or recurrence of dumping and injury." Same is potion under Indian AD rules and laws as well.
